Who He Is 

Attorney John A . Bednarz, Jr., is a highly qualified, experienced, and motivated professional who will assist you when, and if, the need should ever arise.

     Attorney John Bednarz has been practicing law in Northeastern Pennsylvania for 47 years focusing his attention on representing injured workers with their workers' compensation issues and claims.  He has been a Board-Certified Civil Trial Attorney since 1991, after taking an eight hour written exam required by the National Board of Trial Advocacy, a Pennsylvania Supreme Court approved organization. He began practicing law in 1978. Attorney Bednarz prides himself in providing outstanding professional services to all of his clients.

     He has also been named a Super Lawyerin Pennsylvania for over 15 years in the area of Workers' compensation law and only represents injured workers.

Workers' Compensation

     Attorney John Bednarz only represents injured workers and has been handling workers' compensation cases for over 45 years by attending hearings before Workers' Compensation Judges and presenting oral arguments before the Workers' Compensation Appeal Board and the Commonweath Court.

     He was the 2011 recipient of the George F. Douglas Amicus Curiae Award, which was created in 1995 in recognition of outstanding and industrious appellate advocacy. Attorney Bednarz was an active member of the Amicus Curiae Committee of the Pennsylvania Association for Justice for over 20 years and also served as Chair of the Amicus Committee from 2003 to 2005. As a brief writer on numerous cases that have impacted Pennsylvania's injured workers and victims, he served as the gatekeeper for the Amicus Committee in determining and making recommendations as to whether or not a case presented a legal issue significant enough to warrant the Association's formal input in the appellate courts. 

He has written briefs covering a broad spectrum of the law, including the case of of Hutchison v. Luddy (Pa. 1999), in which the Pennsylvania Supreme Court decided in favor of a young man who had suffered harm as a result of the actions of a priest, and the negligent actions of the Bishop and Diocese under which the priest served, finding that the Bishop and the Diocese had a duty to exercise reasonable careto control the priest, even if he was acting outside of the scope of his priestly duties in order to prevent him from harming others, since no matter where his actions took place, he was always acting as a priest. Furthermore, the Court held that since the Bishop and Diocese knew of the priest's propensity for this kind of behavior, they had a duty to take whatever measures were necessary to prevent the priest from harming any more children and found the inactions of the Bishop and Diocese to be not only negligent, but also reckless and abhorrent.

     The preparation of Wills, Powers of Attorney and Living Wills, and the Probate of Estates are very important areas of the law.

     A Will should be made in order to assure he protection of your assets and how they will be properly distributed to the individuals you wish to inherit from your Estate and is of the utmost importance to make it certain to the person or persons you designate to handle your estate and be certain that your intentions are followed to the letter of the law.

    A Power of Attorney designates who will handle your finances and determine the best way to be sure you are cared for if you are not capable of doing so on your own. 

     A Living Will designates the person who will be responsible for following your wishes for your end of life decisions, at a time when making such a decision can be extremely difficult and, is made only when your medical professionals advise that you have a terminal illness and have no reasonable prospect of recovering from that illness and allows you to make the choices as to what should be done at that time, well in advance of the time when such a difficult decision would otherwise need to be made by a spouse, child, family member, significant other, or friend, in the event that you did not ever make a Living Will.
